Heyl Royster’s real estate attorneys provide services related to all aspects of commercial real estate, including critical pre-negotiation project evaluation, negotiation, purchases, sales, construction, and management to a variety of clients. We have represented businesses in the area of commercial retail and office space property as both landlords and tenants from acquisition of shopping centers and strip malls to property management and sales. We have represented developers of real estate, including subdivisions, land acquisitions, easement negotiations, financing, preliminary and final plat approval, and zoning issues. We have represented general contractors in multi-million dollar construction projects including those involving the building of churches, office buildings, schools, airport hangers, hospitals and satellite buildings, and industrial buildings. Our real estate finance experience includes bonding, debt certificates, short-term financing, government-backed financing, refinancing, tax credits, and transactions involving Tax-Increment Financing (TIF) and Special Service Areas (SSA).

In the areas of commercial real estate acquisition, disposition or expansion, our attorneys’ experience includes:

  • Represented the buyer in the purchase of a $5.5 million, 132,000 s.f. shopping center and subsequent negotiation, and enforcement, of leases with tenants.
  • Represented client in the negotiation and construction of a $7+ million hotel project.
  • Represented client in sale 30+ acres of land to developer for construction of subdivision, including coordination with local municipality for construction of necessary infrastructure, PUD approval and Special Service Area.
  • Represented Hospital in approximate $15 million 241 HUD-backed expansion project.
  • Represented a 50% owner of a brand hotel property in dispute with another 50% owner who managed the property through a separate enterprise. Due diligence with the assistance of a forensic auditor disclosed financial irregularities. During negotiations, the client was able to obtain the entire hotel interest for $1.00 and additional scheduled damages payments totaling $150,000.
  • Represented client in acquisition, and development, of top two floors of 6 floor building and with subsequent development of “air-rights” condominium units, with acquisition of necessary easements for full and proper use of condominiums.
  • Represented client in purchase of land and subsequent development of over 250 residential houses.
  • Represented general contractors in negotiation with school districts for construction of elementary, middle and high school buildings.
  • Represented construction client following IEPA Notice of Violation with successful negotiation and remediation with substantially limited exposure and cost to client.
  • Represented an orthopedic practice in the multi-million dollar sale of a 25,000 sq. ft. medical office and surgery center.
  • Representation of a food service supply company in the purchase and then subsequent re-sale of its manufacturing plant in Morton, Illinois.
  • Represented two agricultural cooperatives in the purchase of substantially all of the assets, including real estate, of an independent oil producer. The territory covered three different counties in Illinois.
  • Represented several entities in the purchase of over 20 agronomy facilities.
  • Represented several different companies in the purchase or sale of multiple gas stations and convenience stores.
  • Represented commercial entities in the purchase of both commercial real estate and vacant farm ground for agribusiness-related expansions.
  • Represented client in the sale of a medical office condominium.
  • Represented two agricultural cooperatives in their contribution of all of their grain facilities to a grain marketing LLC.
