Ryan Kemper (Associate)


Ryan focuses his civil practice in the areas of business, municipal, and constitutional litigation. He has handled cases in state courts in southern Illinois and Missouri, as well as federal litigation in the Eighth Circuit Court of Appeals, Eastern District of Missouri and Southern District of Illinois.

Prior to joining Heyl Royster, Ryan served for five years as an Assistant Prosecuting Attorney in St. Louis County, Missouri. While there, he prosecuted a substantial criminal docket, with an emphasis on violent felonies and gun crimes. Ryan successfully conducted multiple jury trials including cases charging armed criminal action, robbery, assault, and murder. In addition, he served as a member of the office’s Special Investigations Unit, with a focus on the investigation and prosecution of officer-involved shootings, election fraud, and municipal corruption. Ryan also undertook significant appellate advocacy, fully briefing and arguing writ petitions and appeals before the Missouri Supreme Court and the Eastern District Court of Appeals.

Ryan began his legal career in 2006 as an intern at the United States Attorney’s Office in St. Louis, Missouri; and in 2007 also served as an intern at the Madison County State’s Attorney Office in Edwardsville, Illinois. After his internships, Ryan worked for a national civil litigation firm located in Clayton, Missouri. While there, he gained significant litigation experience in federal and state courts, primarily representing government agencies and municipal clients in defending their employees, policies and practices against state-law contractual and equitable claims for relief, as well as federal civil rights claims brought pursuant to Section 1983. He also represented local businesses and interested citizens in litigation involving government contracts, development projects, and the validity of municipal ordinances.

Ryan joined the firm’s Edwardsville office 2019. He received his J.D., magna cum laude, from St. Louis University School of Law in 2008, and a B.A., summa cum laude, from Illinois Wesleyan University in 2005. He is licensed to practice law in Illinois and Missouri.

Significant Cases

  • State ex rel. Richardson v. May 565 S.W.3d 191 (Mo. 2019) - Successfully opposed a writ petition before the Missouri Supreme Court, establishing controlling law governing the change of judge rules where the State files a superseding indictment adding charges.
  • State of Missouri v. Muhammad 17SL-CR09748-01 (Mo. Cir. 2018) - Secured a guilty verdict for Robbery First Degree after a 4-day jury trial.
  • State of Missouri v. Mitchell 15SL-CR01143-01 (Mo. Cir. 2017) Secured a guilty verdict for Robbery Second Degree and Armed Criminal Action after a 3-day jury trial.
  • State of Missouri v. Mattox 15SL-CR01098-01 (Mo. Cir. 2016) Defeated a constitutional challenge to Missouri’s criminal statute prohibiting cultivation of marijuana brought by a defendant under the state’s Right to Farm Amendment.
  • DeBold v. City of Ellisville 12SL-CC04208-01 (Mo. Cir. 2014) Represented local businesses in successfully opposing the construction of a Wal-Mart superstore in violation of municipal ordinances governing conditional use permits, including appeal to the Missouri Supreme Court.
  • Affordable Communities of Missouri 714 F.3d 1069 (8th Cir. 2013) Obtained dismissal, affirmed on appeal, of claims for misrepresentation and breach of contract against Fannie Mae arising out of a dispute concerning its Delegated Underwriting and Servicing Program.
  • Faruq v. Garrett 11PI-CC00015 (Mo. Cir. 2011) Obtained summary judgment on behalf of the Police Chief of Siloam Springs, Arkansas on Section 1983 and related claims arising out of the issuance of a detainer against an inmate at the Missouri Department of Corrections.
  • Pinnacle Entertainment, Inc. v. City of St. Louis 4:10-cv-943 (E.D. Mo. 2011) Defeated a request for injunctive relief brought against the City of St. Louis, allowing the City to pursue a casino project to replace the President Casino.
  • Funches v. Ebbert 3:07-cv-226 (S.D. Ill. 2010) On court appointment, served as lead trial counsel in prosecuting a First Amendment claim against the Illinois Department of Corrections under Section 1983 arising out of the denial of an inmate’s right to petition.
  • Mills v. City of Springfield, Missouri 2:10-cv-4036 (W.D. Mo. 2010) Obtained summary judgment on behalf of the City of Springfield on numerous constitutional challenges brought under Section 1983 to the City’s automated red-light camera systems.
