Michael Schag (Shareholder)


Mike serves as the lead counsel in toxic tort litigation for defendants in the construction, manufacturing, engineering, transportation and aviation sectors. He represents contractors, premises owners, product manufacturers, designers, engineers and distributors.  In addition, he represents parties in general products liability, commercial contracts, insurance, regulatory compliance and environmental law. Mike is an Assistant State's Attorney for Madison County, Illinois for the purpose of handling the defense of civil actions against governmental entities.  He is the chair of practice groups on Government Contracts Law and Military Law.

In his role as a career Air Force Reserve officer, Mike is a sitting appellate judge on the United States Air Force Court of Criminal Appeals. Before that he was a trial judge presiding over general and special courts-martial also serving as the Chief Reserve Judge. During his years as an active duty officer, Mike represented the Air Force in environmental litigation, tort claims, contract disputes and was a military prosecutor. He completed the Air Force Judge Advocate General School’s Trial Advocacy and Advanced Trial Advocacy Courses and became qualified for capital litigation after having been selected to attend the Navy JAG School’s Capital Litigation Course. He served as the Denver Area Defense Counsel and then became a Circuit Defense Counsel based out of Washington D.C. trying complex and high-visibility cases around the country.  Before being invested as a judge, Mike performed duties as an evidence consultant for trials having international and operational dimensions and served in quasi-judicial capacities presiding over summary courts, grand jury hearings and administrative boards. In addition, Mike has been a key player in the Air Force's innovative National Institute of Trial Advocacy (NITA)-based TRIALS program as an instructor and senior program leader.

As an Adjunct Professor at Embry-Riddle Aeronautical University for ten years, Mike taught over 25 graduate and undergraduate level courses in insurance, environmental, labor, employment, business, and aviation law. During law school, he was a Merit Scholar and the Executive Articles Editor of the Law Review.

Significant Cases

  • Bueker v. Madison County IL 2016 IL App (5th) 150282 Successful appeal and oral argument resulting in the decertification of a class action as to a governmental entity that was based on claims of sale-in-error and money-had-and-received. The Appellate Court remanded the Plaintiffs’/Appellee’s claims to the trial court for dismissal.
  • Ridenour v. Kaiser-Hill Co. 397 F.3d 925 (10th Cir. 2005) Successful defense of government contractor in False Claims Act appeal averting revelation of classified information and adopting the Sequoia standard of review.
