Luther Presents Workers' Comp Updates to Winnebago County Bar


Kevin Luther presented a Case Law Update to the Winnebago County Bar Association in May. In his presentation, Luther, with the assistance of Brad Elward, summarized a number of notable decisions that took place this past year from the Appellate Court, Workers' Compensation Commission Division, and one case from the Illinois Supreme Court. The update provided a short overview of the more significant appellate court decisions interpreting workers' compensation laws. The decisions covered by Luther included four "Arising out of" cases, and a "Total temporary disability benefits" case in which the appellate court reversed the Commission's findings on TTD benefits to a claimant, as well as cases involving statutes of limitation for repetitive trauma, entitlement to permanency benefits, and a "Refusal to Treat and Choice of Physicians" case.
