Schwab Presents to CPCU Society


On March 20, Gary Schwab gave a presentation on the handling of bad faith claims to the Land of Lincoln CPCU Society Chapter. Schwab covered Section 155 of the Illinois Insurance Code and other theories of recovery that are relied on by claimants to obtain extra-contractual damages arising out of the claimed bad faith of insurers in both first-party and third-party claims. He also discussed how to avoid the imposition of extra-contractual damages and some of the warning signs that a claimant’s attorney may be setting up the insurer for a bad faith claim.
