Heyl Royster attorneys authored two articles for the Illinois Association of Defense Trial Counsel’s (IDC) IDC Quarterly (Volume 23) in the areas of Health Law and Workers’ Compensation.

Attorneys Roger Clayton, Gregory Rastatter, and Matt Thompson authored a Health Law Update called “HHS Releases HIPAA Final Rule to Implement Statutory Amendments under HITECH Act and GINA.” The article discusses the U.S. Department of Health and Human Services’ (HHS) issuance of a Final Rule that seeks to: finalize the modifications to the Privacy, Security and Enforcement Rules under HIPAA, modify the HIPAA Breach Notification Rule, and finalize the modifications to certain sections of the HIPAA Privacy Rule in order to strengthen privacy protections for genetic information.

Brad Peterson authored a Workers’ Compensation Report entitled “Are Temporary Partial Disability Benefits Subject to a Maximum Rate?” In the article, Brad addresses circumstances in which employees are entitled to temporary partial disability (TPD) benefits when they return to work on a light duty basis and earn less than they would have in the full performance of their duties. Brad raises the issue of whether the lack of a TPD maximum creates a disincentive to employers for returning an employee to a light duty position.
