Hefflefinger and Keller Author "Review of Broker Liability" Article for DRI


Partner Matt Hefflefinger and associate Brad Keller authored an article for the Trucking Law section of the January 2014 issue of DRI’s For the Defense magazine entitled “Review of Broker Liability.” In the article, Matt and Brad discuss issues surrounding two theories of tort liability that are generally used by plaintiff’s counsel against freight brokers, and how those theories have been treated by the Restatements of Agency (both the Second and Third Restatements) and the courts.  According to the article, broker liability has become an increasingly popular theory of liability in trucking litigation, and, as the authors state, “In addition to a claim contending that the carrier acted as the agent, many brokers also face a claim involving negligent hiring or selection.”
