Patrick Cloud authored an article for the December issue of The Federation of Defense & Corporate Counsel’s FCCCInsights entitled “Settling Without Consent: The When and the How.” In the article, Cloud, who is chair of the firm’s Insurance Coverage Practice, discusses how courts sometimes find themselves in a “thorny balancing act” of either binding an insurer to an unauthorized settlement, or enforcing policy language that gives the insurance company the power to control the defense of the insured. Cloud’s article provides practical guidance on how insurers can protect their interests in these types of situations.
