Barron and Hansen Article Examines the Parameters of Illinois’ Medical Studies Act


Ann Barron and Mark Hansen authored an article for IADC’s Medical Defense and Health Law Committee newsletter entitled “The Illinois Medical Studies Act Privilege after Grosshuesch and Eid.” The article examines the decisions of two Illinois appellate courts that basically agreed that documents generated specifically for the use of a peer review committee are privileged under the Illinois Medical Studies Act, but came to different decisions based on the different factual scenarios of each of the two cases. In Eid, the court found the documents at issue were protected under the Act, and in Grosshuesch the court determined the documents were not privileged. In the article, Barron and Hansen provide specific recommendations for healthcare facilities in light of these rulings, including incorporating specific provisions into their bylaws and enforcing good record-keeping procedures.
