Firm Successfully Defends Prison Healthcare Nurses


On April 17, John Hoelzer and Mike Kokal obtained a defense verdict in a jury trial for the firm’s clients – three nurses who worked for a prison healthcare provider. The plaintiff, an inmate in an Illinois Department of Corrections facility brought a “deliberate indifference” lawsuit against ten defendants, including the firm’s clients. He alleged that they failed to properly treat his lacerations and other injuries from an altercation. He further alleged that, for about two weeks, they failed to provide him with cleaning solution for his prosthetic eye, which resulted in an infection in his eye socket. The case was tried in the U.S. District Court in Urbana, IL. There was testimony from about a dozen witnesses, and after approximately an hour of deliberations, the jury returned a verdict in favor of all Defendants.
