John Heil Pens Article in IDC Quarterly


John Heil authored an article in the current issue of Defense Update (Volume 20, Number 2), the Illinois Association of Defense Trial Counsel’s Civil Practice Committee newsletter. John’s article, “Appellate Court Provides a Primer on Supplementary Proceedings Against Third Parties,” discusses Hayward v. Scorte. This case involves a home remodeling project gone bad, and the attempts to recover a substantial judgment against the contractor and it’s officers. Although the Illinois Appellate Court, First District, was sympathetic towards the plaintiffs, premature entry of judgment caused the circuit court decision to be reversed. John sums up the case, “[a]lthough supplementary proceedings involving third parties under section 2-1402 can be complicated, the Hayward decision serves as a reminder to courts and litigants alike of the perils of skipping steps in such proceedings.”
